Terms of Service
Effective for all WasteForge accounts.
1. Acceptance of Terms
By creating an account, checking “I agree,” or using WasteForge in any way, you (“Customer,” “you”) agree to these Terms of Service (“Terms”) on behalf of yourself and the business you represent. If you don't agree, don't use WasteForge.
2. What WasteForge Is
WasteForge is dispatch, tracking, and billing software for roll-off dumpster haulers. WasteForge helps you manage your own operations, customers, drivers, and invoices. WasteForge is a software tool only. WasteForge is not a waste hauler, does not perform waste collection or disposal services, and is not a party to any agreement between you and your customers.
3. Your Account and Responsibilities
- You're responsible for everything that happens under your account, including actions taken by your staff and drivers.
- Your data is yours. You own the data you put into WasteForge (customers, containers, jobs, invoices). You can export it to CSV at any time from Settings, and we will not hold it hostage if you leave.
- You're responsible for the accuracy of the data you enter (pricing, customer info, invoices) and for your own compliance with local, state, and federal waste-hauling regulations, licensing, and permits.
- You're solely responsible for your relationships with your own customers, including service quality, disputes, refunds, and collections.
4. No Warranty
WasteForge is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the software will be uninterrupted, error-free, or secure.
5. Limitation of Liability
To the maximum extent permitted by law:
- WasteForge (and its owner/operators) will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost revenue, lost profits, lost data, or business interruption — arising from your use of or inability to use WasteForge.
- WasteForge is not liable for disputes between you and your customers, for missed or incorrect pickups/deliveries, for data entered incorrectly by you or your staff, or for third-party services you connect (like QuickBooks).
- Our total liability for any claim relating to WasteForge will not exceed the amount you paid us in the 3 months before the claim arose.
6. Indemnification
You agree to indemnify and hold WasteForge harmless from any claims, damages, or expenses (including legal fees) arising from: your use of the software, your violation of these Terms, your violation of any law or regulation, or your disputes with your own customers or employees.
7. Dispute Resolution — Arbitration & Class Action Waiver
This section limits how you can bring a dispute against us — read it carefully.
Any dispute arising from these Terms or your use of WasteForge will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. You and WasteForge each waive the right to a jury trial and to participate in a class action, class arbitration, or representative action.
8. Termination
We can suspend or terminate your account for violating these Terms or non-payment. You can cancel anytime; you remain responsible for charges incurred before cancellation.
9. Changes to These Terms
We may update these Terms. Continued use after an update means you accept the new Terms. Material changes will be flagged in-app.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
